Resignation and nomination for office on a council
55(1)A member of council is elected to hold office until the first meeting of an incoming council following a general election.
55(2)Subject to subsection (3), a member who resigns is not qualified to be a candidate at a by-election held to fill the vacancy created by the member’s resignation.
55(3)Before a member of council may file nomination papers for any other office of council in a by-election, the member shall resign their office as a member not less than 21 days before the day set for the close of nominations and shall without delay send notice of the resignation to the Municipal Electoral Officer.
55(4)The Municipal Electoral Officer shall, on receipt of a resignation notice referred to in subsection (3), without delay declare a vacancy and call for nominations to fill the vacancy so that the vacancy may be filled at the time of the by-election mentioned in subsection (3).
